RETAINER AGREEMENT
This will confirm that (CLIENT NAME)______________________________________, Hereinafter known as CLIENT, is/are employing LIABILITY MANAGEMENT INTERNATIONAL, INC., hereinafter known as the INVESTIGATOR to initiate inquiries and/or conduct an investigation and/or reconstruction regarding the following matter: _________________________________________________________________________________
Investigators hourly rates and travel time for this matter will be per the most recent published rate card of the Investigator, $________ per hour and $0.50 per mile. Investigator will forward Client statements and/or invoices listing in detail any and all time and expenses incurred in the investigation/reconstruction of the matter.
If courtroom testimony, or deposition, regarding this matter or any matter related to it is required the fee will be $1000.00 per day in court and $600 for any four hour portion in deposition. All court room and deposition fees are due in advance. Included in Client's bill will be any costs incurred by Investigator for long distance toll calls, meals, lodging, data inquiries, copies, subcontractors fees, etc., in reference to this case. Investigator will supply Client with receipts for meals and lodging when incurred.
Investigator will supply statements and/or invoices upon completion of various phases of the investigation/reconstruction, which Client agrees to pay immediately upon receipt. A finance charge of 1.5% per month will accrue on all costs and fees 30 days or more past due.
Investigator will commence work in this matter upon receipt of a retainer in the amount of $2,500.00, which will be applied to the fees incurred. This retainer is non refundable regardless of the disposition of the case.
Client and investigator mutually agree to keep one another fully advised of evolving developments and/or newly developed data that could reasonably be considered helpful to the investigation/reconstruction in progress.
Investigator agrees to faithfully obey all applicable laws of the state of California and the United States in the course and scope of this investigation.
Should any litigation arise from this agreement resulting from nonpayment of fees, the prevailing party shall collect all attorney's fees and costs resulting from the litigation.
Should any litigation arise from this case through no fault of the Investigator, or his employees, the Client shall pay all fees (including the regular hourly rate of the Investigator) in addition to any costs sustained by the Investigator in the litigation process.
The investigator declares he is licensed by and through the California Bureau of Security and Investigative Services. License number 22785. The investigator also declares he also holds Private Patrol Operator License number 14490.
This agreement shall be binding upon Client's heirs, executors, and personal representatives. Client, by signing this agreement, certifies he/she has thoroughly examined and fully understands the foregoing agreement.
Investigator and Client mutually agree that all information regarding this matter will be kept in the strictest of confidence.
